End User License Agreement

To use this product you must read and agree to be bound by this License Agreement.

If you do not agree, do not proceed or use our products.

Our products, including all software programs, data, printed or electronic documentation, are licensed to you the legal entity of the end user, pursuant to the terms of this license agreement. This license agreement is a legal agreement between you and Skunkworks Australia Pty Ltd ABN 58 102 226 853 (hereinafter called SWA). By installing, copying or otherwise using any part of theses products you agree to be bound by these terms:

1. All copyright, trade marks, any related patent, or intellectual property right in the products are and remains the ownership of SWA.
2. Our products may only be used by you in accordance with their intended use as described in the technical documentation provided.
3. Our products are not sold to you, but rather licensed to you to be used in accordance with the terms of this agreement. This license automatically terminates if you breech any of the terms of this agreement.
4. Our products are licensed on limits of the number of resources that can be used concurrently (eg number of voice resources, network resources, conference, fax, video resources, etc) and must not be used to exceed these limits.
5. You must not sell, loan, rent, lease, transfer, assign or sub-license our products without the prior written consent of SWA.
6. You must not attempt, or allow, or cause a third party to decompile, disassemble, reverse engineer, copy, reproduce, transmit or modify our products in whole or in part. You may make one copy for back-up purposes.
7. Up to 4 channels of Whirlwind are provided as a free trial and not for commercial deployment. Email support is included subject to fair use as determined in the absolute discretion by SWA
8. Commercial product support is not provided to you under the terms of this agreement. Commercial product support is available under a separate agreement.
9. To the extent permitted by law, SWA excludes all warrantees and representations relating to our products. SWA does not make representation or give any warranty as to the content, accuracy, commercial benefit to you, or the suitability of our products for your intended use. To the extent permitted by law, SWA shall not be liable in contract or in tort, including negligence, or otherwise for any loss or damage, business interruption, lost profits or goodwill, lost or corrupt data, including indirect or consequential loss or damage, however caused, which may be suffered, or incurred or which may arise directly or indirectly in respect of the use of or inability to use our products.
10. To the extent permitted by law, SWA excludes you from any other rights in relation to our products.
11. This agreement is governed by the laws of South Australia, Australia
